California Expungement Filing Form

Could you please tell me what form would be used to file for an expungement of an arson conviction (San Diego County) in 1995.

Re: California Expungement Filing Form

I believe there is a form from (old) P. C. Section 1203.4 that permits you to petition the court to grant a reduction of a Felony to a Misdemeanor conviction, and a Misdemeanor to a non conviction. However, P. C. Section 1203.4 has been changed, and doesn't exist at this time with that designation. So it's probably in the new Sections 1203.44, 1203.45, 1203.46, 1203.47, 1203.48 and 1203.49 series of penal code. You might also look at P. C. Section 179(b).

When all else fails go to your local court, and ask the Criminal Court Clerk for the form.

When all else fails that's what I do. That's why I get the big bucks.
