Legal Question in Criminal Law in California

Changing Plea

Can a guilty plea be changed to not guilty? Court transcripts will indicate that the Public Defender counsel that was court appointed was said to be ''not properly representing me'' from the presiding Judge during the arraignment hearing.

Re: Changing Plea

Generally, yes, it can be done on various possible grounds although it is not necessarily easy. Counsel's improper conduct at arraignment, rather than plea and sentencing hearing, is not among them but ineffective assistance otherwise or any possible problems with the legality of your plea would matter. Another big factor is how long ago your plea took place.

Keep in mind by changing your plea you are re-opening your case and might have to take it to trial.

I am very familiar with motions to set aside guilty pleas. Feel free to contact me directly.
