Legal Question in Criminal Law in California

I was cited for possession of nitrious oxide for inhalant. But i recieved a letter saying i was getting charged with misdemeanor DUI. At the time the officer didnt give me a blood test. Or anything. Now im wondering if i have a greater chance of winning my case? Or even a D.A. Reject

This is a interesting question, for which there is not enough information for me to give you an answer. Arrested for possession of nitrous. Charged with a DUI, but no blood or breath test. Did the cop take your driver's license? Could the cop claim that you refused to take a breath or blood test? A DA reject? Sounds to me like you're passed that stage - the case has been filed already. So what to do? Talk to a lawyer who can ask you the right questions to get the right answers to make some preliminary estimates of what you are facing and take immediate steps to minimize the potential damage you're facing.
