Legal Question in Criminal Law in California

Cleaning of Name After Probation Period is Completed

Does our criminal system have any written rules where an adult was charged with drug possession but did not serve any prison term and was given probation of 2 years and has successfully completed probation -- how can the charge be written off the record in order to successfully retain long term employment in the future and prevent the individual from being ''black balled'' with any future employers?

Penal Code section 1203.4 allows you to deny the conviction after the probationary period is over. You have to petition the court where the conviction occurred and give notice to the prosecutor, but if you haven't been arrested since the offense, and you successfully completed the probation, it should be granted. There are some exceptions to the rule about denying the conviction, however. You should see a criminal lawyer near you about this. This reply supplements Steve M.'s reply.

I am wondering why you were not offered a P. C. Section 1000 drug counseling program at the time of your arraignment. Which would have dismissed the conviction after you completed the program. I'm wondering if you understood your conviction.

CHECK WITH THE COURT CLERK ABOUT YOUR CONVICTION WHEN YOU OBTAIN YOUR FORMS TO FILE THE P. C. SECTION 1203.4 REQUEST FROM THE CRIMINAL CLERK.
