Legal Question in Criminal Law in California

This is embarrassing but here goes.

I am a man who posted an ad in the Craigs List Casual Encounters section looking for female companionship. Several responses came in to my e-mail. I e-mailed one gal who wrote me several times. I asked her several times where she lives and her age but no reply. She then asked for photos. I sent this requestor a nude photo of me. This person then wrote back saying I looked good and wanted to text me and asked for my phone. I sent my phone #. She wrote back saying she will write me back later when she gets free. She wrote me later that night but I did not respond. This morning I received a phone call forma man saying he is this persons father, that she is his 14 y/o daughter. I told him she wrote me and I did not know. He states he is taking this to the police for prosecution. I told him I would never get involved with a minor, that she wrote me. Again, I did not know and she approached me. I am concerned what can happen to me.

Do NOT speak with law enforcement.....EVER....As a Former DA, and a Former Judge Pro Tem, you need to speak to a criminal defense expert. Call one who has experience and knows how to handle these cases.....Most of us offer FREE consultations, so make a call NOW.....I hope that helps. David

Mr. Wallin's advice is very sound.

Let me add, though, that I've heard stories like yours several times before. They often lead to a demand for money, either from the father or from someone claiming to be a law-enforcement officer. If you get such a demand, this is almost certainly a scam. Police and other law-enforcement officials in this country do not make that sort of demand, and they certainly wouldn't offer to drop a potential sex-offense case with an underage victim in exchange for money. Perhaps some parents would, but a father who was genuinely upset about something like this likely would not let it go in exchange for a quick payment.

I'm not saying this really is a scam. It might be exactly what it looks like. And I suppose there is some risk you could be prosecuted, though that depends on additional facts.

Whatever you do, proceed with caution. Good luck.
