Evading Police A Felony?

My stepson was stopped by the city police, Hanford CA, and was interviewed. When the Officer asked for his Identification he ran, stupid I know, he ran just one or two blocks. When the officer caught up to him and ordered him to stop, he stopped. No resisting, no other issues, he stopped when ordered to. He was in possession of Meth so they arrested him. The problem is the charges of poss. are misomenor chargres but they filed the Evading Police as a Felony. Per Penal Code 148 it should be just a Mesomeanor. Like I said, no other issues he did not resist and he was not driving a car. He just ran two blocks and stopped.

District attorneys often over charge. You can best assist your son by retaining an attorney to represent him in this matter. Also you son should not discuss this with anyone other than his attorney.
