Legal Question in Criminal Law in California

Hi everyone,

I have a record of arrest, by LAPD. I was detained by LAPD for domestic violence, but case was removed even before hearing. I just had an pre-hearing interview with court clerk who desisted a case. Unfortunately, record of my arrest is still showing of my record. I filed for seal and destroy my crime record, but courthouse says that I have no record because my case was rejected even before judge. How do I take off the record of my arrest?

The only way to get rid of arrest records is to file a petition for a finding of factual innocence. I suggest you speak to an experienced criminal attorney before doing so, as there is the possibility that the prosecutor could refile charges if the statute of limitations has not run.
