Legal Question in Criminal Law in California

evidance release

if the gun charges have been dropped in the case, can the

police department still hold my guns in evdiance?

i have all

the paper-work of ownership and state gun relases?

but it seems like the local police that seized the guns

dont want to give them back. because they know they were

wronge in the first place.

so who do i go to that can make the police department

give my guns back?

Re: evidance release

You can a file motion based on PC 1538.5 for the return of the guns. If the court orders the return of the guns, then they will be returned.
