felony evading defense

If a person who was driving a vehicle that was involved in a short pursuit, but got away from pursuing officers after an accident, but the passanger was apprehended after a short pursuit, would the driver be charged with any crime if he came to testify on behalf of the passanger that he was the driver, even if he got away?

Unfortunately you are asking lawyers, and my advice, and I assume the advice of other lawyers, would be to look out for #1, keep your mouth shut, stay away from the police and the courthouse, and hope your homie is a stand-up guy and takes the rap (if any) for himself.

I never understood why they arrest the passengers in evasion situations. You can't evade the police from the right seat.
