Legal Question in Criminal Law in California
If a Juror says to a Judge that he cannot understand English 100% and the Judge replies: "You know, I don't understand English. Sometimes I think I do, but often I find that I am wrong." Shouldn't the Juror have been dismissed and replaced with an alternate? Can the defendant have a re-trial based on the Judge's reply to the Juror?
