Legal Question in Criminal Law in California

minor faced with embezzlement

What can a minor facing an embezzlement felony expect? I was not arrested, just told a court will contact me. That was a month ago. Will receipts showing restitution was paid more than was agreed help in court? And how can I clear this off of my record/will it go away when i turn 18? And to what extent will it go away?

"Will receipts showing restitution was paid more than was agreed help in court?" Yes. They will help the prosecutor, since they are good evidence that you have admitted your guilt. They may also help you when and if you are sentenced, but by that point you will already have been convicted.

You should have had a lawyer help you deal with this from the outset before you made matters worse for yourself. You should get one now before you make things even worse than they already are.

Re: minor faced with embezzlement

As a former Deputy District Attorney who has handled 100's of juvenile matters, I hope to answer your questions. The resolution you want is a 790 DEJ . If you complete the (usually 1 year of probation, the whole case would go away as if it never happened and your record of this incident would be sealed automatically. Paying back the monies is not only good but is a prerequisite to resolving this case the way you want. I wish you well. David Wallin
