Petty Theft Second Offense

I had a petty theft charge reduced to an infraction 2 years ago, I just got charge with a misdemeanor petty theft yesterday, my court date is in 2 months, am I likely to go to jail or have to serve community service or will they go easy and just give probation?

While the details of your case matter, i.e., what was stolen and how etc., given the fact this is your second theft case there is very good chance DA will seek county jail with or without probation. Felony charges or not likely as the first case was an infraction.

A second petty theft charge can be charged as a felony. But they have to prove their case. Get a lawyer. If I were the judge, it would be obvious to me that you learned nothing from your first theft conviction, and I would throw you in state prison without hesitation.
