Legal Question in Criminal Law in California

Prescription Fraud....

My brother hurt his back and had surgery 8+ years ago but during the course of all this he has been taking Prescription pain meds for 10+ years. he developed tolerance for the drugs and started seeing multiple docs. when they found out they all refused to see him. Between the drugs, the withdrawals the pain and his bipolar disorder (poor impulse control) he did something extremely stupid and forged a prescription (a couple times) 3 months ago. he had such a good relationship with the pharms for so long that they never questioned it. Now he's clean and in a program, but he is tearing his self up with guilt, fear, etc. It's been so long is it possible no one will notice? is he facing likely jail time? how is it likely to go down? Will the police smash in his door in the middle of the night or come to his work to arrest him?

Re: Prescription Fraud....

Yes, it is possible no one will notice. Of course he needs to stop his conduct and it would be best if he did not go to the same pharmacies ever again.

He does not have any obligation to "fess up" and he should not do so. He will be prosecuted if he does - there will no free ride for him.
