Legal Question in Criminal Law in California

section 242

How is it that I am being charged with this when I walked away from a fight. My friend was hurt and ''I'' now have a restraining order not to come within 250 ft of this same friend.

Re: section 242

People get charged for things they did not do all the time - welcome to life. Cops lie, witnesses lie, friends lie. If you have an ongoing case, it is incumbent upon you to get a lawyer and defend yourself. There is no short cut here.

Also, having a restraining order issued against you is not the same as having been convicted of anything. Restraining order is precautionary in nature. Someone essentially has to tell the court they have grounds to be afraid and the court will usually issue the order. The order will be pretty much automatic if it is not permanent, i.e., it is limited to the time when the case is being litigated.
