Re: Statutory Rape/ Age Of Consent Between Minors

R. Miller's answer is the model of brevity and completeness. Minors can't consent but they can have unwanted pregnencies. And as soon as the boy becomes a man on his 18th birthday. He's in even graver danger of being prosecuted and going to prison. I answered a parent's inquiry earlier on the arrest of an 18 year old male who is living with his girl friend, who is a minor, and their child. He's been arrested and is being prosecuted.

Re: Statutory Rape/ Age Of Consent Between Minors

Thanks for your question. In California, the age of consent is 18, PERIOD. There is no exception for consent between minors. In fact, the D.A. will, and often has, prosecuted both parties for statutory rape when two persons have sex and are both under the age of 18.

I hope this helps, and please feel free to call me personally at 1-877-568-2977 or email if you have any questions.
