Health and Safety code 11364 or Business and professions code 4160 both outlaw drug paraphernalia and/or syringes does not mean a case is indefensible...but charges can be brought.

It is illegal to have syringes unless they are part of a doctor's prescription. The prescription need not be for diabetes; there are many other medical conditions for which doctors prescribe injectable medications and syringes.
