Legal Question in Criminal Law in California

is there a time frame or "limit" for a peace officer to issue a citation? in the situation being the civilian had been arrested for violation code 11550 but instead of booking the person that was arrested was admitted to the M.Valley Hospital for severe chest pains. Later discharged on self reliance. No further police contact was made on this date ; august 8, 2013. on 2/09/2014 the afformentiomed peace officer approached this civilian and searched her and then cited that person for the supposed 11550 a misdemeanor offense. at that time the civilian was not on probation and had rights for search and seizure. can you please inform me of my legal rights and legal obligation the sherrifs dept. must abide by in the situation now standing.

You need to speak to a criminal defense attorney in person. I'm confused by your post, because I do not know whether you are being cited for an offense on August 8, 2013, or the later date of February 9, 2014.
