Legal Question in Discrimination Law in California

My boyfriend and I currently live in a two bedroom apartment. We were trying to move two apartments over into a one bedroom apartment, in the same complex to save some money. We were denied being able to move in because my boyfriend has bad credit, even though he had bad credit when we moved into the two bedroom. Are we being discriminated against?

It is only against the law when it is invidious discrimination, that is acting against an individual for what is considered an improper purpose, such as race, creed, sex. Bad credit is not a barred matter. It is not unreasonable for a landlord to change their mind as to what type of tenant you might make, or to simply think that if you have paid your rent on time why not keep you in the unit. that pays a higher rent then move you into a lower rent paying unit and have to find someone willing to pay more. What the landlord is doing is legal, even if it appears unfair to you.
