Legal Question in Discrimination Law in California

Being forced to quit after19 years

What do I need to prove discrimination of one of the largest corporations in the world. How do I get an attorney interested and not afraid of a large corporation? I have been put on probation for the 1st time, out of 16 years of promotion in the company, almost one year ago and it has been extended 2 times with no explanation. I have been told by a temp that she was told that they are trying to make me quit. I have been demoted in the past 3 years from a middle range position down the scale to an entry level position by someone who told me ''I will make your job what I want.'' Help!!!

Re: Being forced to quit after19 years

First, you have to be discriminated against because you are part of a protected class. Race, gender, age (40 or over) and religion are some common protected classes.

Second, you have to prove that an adverse action against you was motivated by discrimination based on your membership in a protected class.

Third, the employer gets a chance to prove that there was a non-discriminatory reason for the action against you.

Finally, you have a chance to prove that the reason the employer asserts justified the action was only a pretext for discrimination.

In other words, job demotion or termination alone is not sufficient. It has to be based on an illegal discrimination.

Almost any employment lawyer would be willing to sue a large corporation in this kind of case if there were facts to justify it. The larger the defendant the more damages they are able to pay.

This is a general statement of law and you should consult with an attorney who can review the facts of your situation and advise you.
