1st time DUI, is a legal Rep. needed

1st misdemeanor DUI, is a lawyer needed for the DMV and court appearences.21 years old and short on funds, is a payment plan possible for legal assistance?

I agree that an attorney should always be used, but in the case of a first-time dui, it may not be necessary. If there are no constitutional issues, if the BAL is way over .08 and not just hovering, then you don't need an attorney. If you are simply guilty of a DUI and there is no property damage/personal injury, then the penalty is going to be the penalty no matter whether you have an attorney or not.

The good part about having an attorney is that the attorney can go to court on your behalf without your presence and enter your plea and get you enrolled in the programs in which you need to enroll.

My advice is yes. If you don't have an attorney, you are just hoping the DA is going to be "nice" to you. In order to fight a DUI, you need the assistance of an experienced attorney who knows what to look for in a deficient DUI prosecution. Many attorneys can provide a payment plan, you just need to ask.
