Legal Question in Education Law in California

Repeating 9th grade

My son is currently in 9th grade at a private school but still 13 years old. Academically doing well A's/B's. We are not happy at private school and believe he is not emotionally/socially mature enought for high school at this age. Woudl like to pull him out of private school before the semester end (thus receiving no high school credits) and home school him until Sept. 07 and then enter him into our public high school as a freshman (not worrying about any transferring credits). I have been told by our public high school that we can not do that because he is already a freshman and ''their policy'' is not to have any grades repeated (although they do allow fifth year seniors). We want him classfied as a freshman/freshman classes/ sports and a report card that shows 4 years of high school. The Principal stated they would not allow it based on my son having an ''unfair academic advantage'' over othe students. I would like to know if I can demand his placement as a freshman in Sept. 2007 if he has no accredited school credits to transfter. Please help the semester ends in 2 weeks and I believe this would be no problem, he's good student, no discipline problems, etc. Thankyou.

Dear Repeat!

The high school principal is not the end product source for you. Contact the Administrators at the School District and present the same issues. If your son was to "drop out of school" and then re enroll, it is less of an issue as well.

Each school district will be governed by its own set of rules. There will not be a simple "correct" answer to your problem as it is District specific. You need to go to the District office, sit down with someone and go over the issues.
