Legal Question in Elder Law in California

monitary gift to caregiver

My aunt lives in a board and care and it has come to my attention that my aunt wrote a check to one of the caregivers in the amt of $1,000.00. (this was a gift) she cannot afford to do this. she already pays the owner for all of her care. I know this is unethical but is't it also illegal for the caregiver to accept and cash the check? How should I handle this?

Speak to the owners, even if they accpeted the gift. Let them know it is not appropriate. Then speak to the State Licensing Department.
