Legal Question in Entertainment Law in California

My brother is on Concord Records and his website was managed by my older brother who (somehow) overlooked the renewal date. Consequently, someone came in and bought the name during it's lapse and is selling it for several thousand dollars. Is there any recourse for getting the site back without paying the asking price. It seems as though, someone lifting a website to profit off someone's name would be illegal (almost bribery)... but I do not know...and would love to know your thoughts. Thank you.
