Legal Question in Entertainment Law in California

Legalities regarding use of a persons image in video

1. I plan to release a DVD (for sale, both national and international). There are a couple a people included in the documentary that I don't have release forms for. May I legally use the footage if I blur/cover their faces?

2. May I use said footage if I have a person's permission to use their image documented on video, but not in paper? (IE: ''I better see this interview in your DVD'')

To your first question, if the person's face is adequately covered (and voice eliminated) then you will be ok. If you can find the persons that you are including, you really should get a signed release. Legally you may be ok but why risk it.
