Legal Question in Family Law in California

Affair/Spousal support question

Hello,

My wife is having an affair and I know with whom she is having the affair. Is there any legal action I can take or anything I can do to stop it or to prevent him from having contact with her (such as a restraining order)?

Also, if I start the divorce process and she quits her job, will this have any impact, positive or negative, on any potential spousal support?

thanks

In a general sense, California is a no fault divorce state, and as a result, your wife's infidelity will not be an issue. You can not obtain a restraining order on her behalf. If she quits her job, a court might impute the income to her depending upon the circumstances.

For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
