Legal Question in Family Law in California

please i need answers

hello i have a problem with my daughter dad we are not together i was 17 when i got pregnant and he was 21 he want to be with my daughter i let him but he was been calling my house drunking asking from my baby she dont even talk and he tell me all kinds of stuff like tell me of and tell me that he is going to take me to court and he is going to get her custody he is on probation and he used alchool costely he calls my house late at night drunk acting stupid and he says he says that he is going to jail for something iguess he did but then he tells me that he has to go to anger managment classes and im moving far so i dont want his family thinking that im stilling my own daughter cause she has his last name so i want to see if i have a case to get my daugter whole custody.

I would recommend bringing an ex parte application for a temporary restraining order to keep him away from you and your daughter.

You probably should consult with an attorney. In this type of case, if it is severe as it sounds, you could go to court for a restraining order. Tell the court you don't believe he should have visitation at this time because he is drinking, and that if he wants visitation, that it should be monitored for now.
