Legal Question in Family Law in California

help! the biological father of my son is not named on my sons birth cert. My previous boyfriend was.. until we wnt to court and asked that his name be removed from b.cert. due to dna test proving he was not the father. The judge ruled in his favor .now, yrs later the true biological father of my son did sign a declaration to establish parentage. but that is as far as it went. I never amended birth certificate nir changed my sons last namethe physical birth cert. still reads my exs name . so legally does signing declaration alone actually legally mean my gathers biological father has rights or does it establish parentage at all? do we need something more legally done?

You will need an action establishing the bio father as the father of your son and will need a court order amending the birth certificate.
