Child support

My ex-son-in-law had been ordered by the court, in Ventura county, CA to pay child support for his 2 childern , living with my daughter. In August of 2008, my daughters body was found so my wife and I went to court to become the legal guardians of the two childern. Now my ex-son-in-law has stopped paying the child support and now is taking us to court saying that the survivor benifits from social security are intended to replace his child support. I have always thought that each parent has an obligation to support their children. The fact that the mother is now dead only means that the SSA survivor benifits is taking care of her obligation. The ex-husband still should be obligated until the children reach 18. Please help.
