Legal Question in Family Law in California

Child support increase

The father of my 6 year old son has no visitation. The court ordered him to supervised visitation almost 3 years ago to reintroduce the 2 after father had not seen my son for so long. Father refused supervised visitation. Father works 2 jobs,1. a concrete construction business owner, who hides his income.2. he is a security bouncer at a nightclub 4 nights a week. Married a 21 year old girl who just had his daughter. he will not let wife work so there is no traceable income. Please tell me how to increase his support payment of 300.00 per month, when i cannot prove what he makes? i served a wage assigmnent on the nightclub they said he is not an employee but is a 1099 sub contracted employee so still no idea what his monthly earrnings are. Thanks for any advice you can offer me.

Re: Child support increase

Contact the local family support unit. This is a government agency, with power that is not available to others.

You need to do discovery. He will be required to answer questions under oath. If you prove he is lying (i.e. thorugh a private investigator or a friend) then the court will really stick it to him in a child support hearing.
