Legal Question in Family Law in California

My child is turning 18 in January. He lives full time with his mother and she is letting him do independent study, so he is not "attending" school. Do I have to pay child support until he finishes 12th grade or do support terminate at 18.

Although its called "independent studies", the programs are normally run by the high school, the program earns credits toward graduating, and therefore, he is more than likely still in "attendance" even if he's not physically showing up to a classroom. Therefore, it is more than likely you will need to treat his current position as though he were showing up to class each day.
