Legal Question in Family Law in California

Child Visitation & Non-Payment of Child Support

My ex owes $25K in child support for a child that is only 3 years old. He is still entitled to visitation in Ca (he lives in a different state) once a month. What options do I have to stop visitation?

Re: Child Visitation & Non-Payment of Child Support

Non payment of support does not, in and of itself, provide sufficient grounds to terminate visitation.

You need to seek the proper remedy , ie: be aggressive in looking for the unpaid arrears.

Without more facts you have no options to terminate visitation. There is no legal connection between the obligation for payment of support and the right to visitation. However, you have many options to enforce the current child support order. Give my office a call and set up a phone appointment and I can give you some suggestions. Good Luck, Pat McCrary
