Legal Question in Family Law in California

Community Property & Business owned prior to marriage

I have been married for 7 years. My husband is a Sole Proprietor in his business which he owned prior to our marriage. My wages were used to by new equipment and pay business debt during our marriage. He purchased vehicles under personal loans for the business. We never had a separate family bank account and co mingled funds with personal and business to pay our bills and make all new purchases. My question is whether assets bought for the business are considered community property. My husband has taken control of the business account and left me pennyless. He has a lawyer and I can not afford one. He has not filed for a divorce yet but moved out to live with his girlfriend.

Re: Community Property & Business owned prior to marriage

The business is a mixture of separate property and community property. It will take a sorting of the evidence to determine the value attributible to each. You must get an attorney to establish spousal support and to litigate the business. Do what it takes. Good Luck, Pat McCrary
