Cps and child custody

My 27 yr.old daughter was arrested yesterday for posession and child endangerment and my 8 yr.old grandson was taken into CPS custody. If my daughter signs temporary legal guardianship over to me will I be able to get him from cps or will I have to go through the Courts.

Your daughter should request that the child is placed with you. You have an excellent chance of being the foster parent. You will have to follow the rules set out for contact by CPS. It will also help if you are willing to adopt if mother does not reunify with her child. If the father is present and capable of taking care of the child he will have priority.

The child is now in the custody of the state. You need to be joined in the action if you want to have custody of your grandchild. You should hire an attorney who can represent your interests.
