Legal Question in Family Law in California

custody of a minor

If a child doesn't want to stay with a certian parent on his or hers court orded weekend. Can the parent be arrested if they refuse to let the child go? Because the child just dosen't want to go over at a certian parents house all the time. The child is 16 years old can't she make her own mind up if wants to go or not. Thank for any help you can offer.

She cannot refuse has she is a minor. You can file an order to show cause to modify the current child custody order. The court will consider her desires in making any modification to the current order. Good Luck, Pat McCrary
