Dad deported

I separated from my child father. I never filed for custody of her. He went to jail and now he got deported. He can't come back for 5 years. How do I file for custody now that he is gone?

In a general sense, you can still file for custody if you reside in California. You may have to serve him by publication, if you do not know where to personally serve him.
