Legal Question in Family Law in California

My Daughter is 16 years old & has a 8 month old baby girl, she & the baby live with us parents, the father is not on child support but is registered as the father, he provides the baby food & diapers only, we want to go to a vacation for 2 weeks out of the state, do we need his consent to take the baby out of the state? he disagrees & says he won't allow it.

Please Help!

Currently there is no custody order. You might need to start an action for child support and corresponding custody orders. You guys need to find some routine nature to your custody since it hasn' been established yet. Technically it is not appropriate to leave the country without giving notice to the other parent. However if there is no danger of kidnapping I don't see what the harm is.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
