Divorce

I am going thru divorce with my wife we have 2 kids

i am on l-1 visas she is on l-2 dependant so are kids does she and the kis lose status although i have asked for legal custody of kids and she responded she does not want to divorce

You may want to ask an immigration attorney.

As far as her response to the divorce, you can get a divorce whether or not she agrees.

yes...your wife will fall out of status...but not your children. Even if you are divorced...children can always be your dependent.
