Legal Question in Family Law in California

divorce-deferred sell of home

My ex is a court clerk in family law and nobody in my county will give me a consultation because of conflict of interest. I could really use some help.

My ex wants to defer the sell of our home. We've been divorce since 8-05. The language of the law says that it is ''temporary''. When I asked her what her idea of temporary is, she says that she wants to leave that up to the kids and when they feel comfortable with the idea of leaving the house. She also threw out the term ''age of majority'' and I don't know what that means. Can you tell me what the heart of the deferred sell law is? I'm assuming that it is a short period of time that gives the children time to adjust to the shock of the divorce before further shocking them with displacing them from the home. But in my case we have been seperated 2 years, divorced 1 1/2 years and I have moved twice and since been remarried. The kids are pretty adjusted to the divorce so I think this law doesn't apply. Thank you for your time.

Re: divorce-deferred sell of home

The age of majority simply means that when the children at issue turn 18, and are no longer legally considered minors for the purposes of the law. As far as the deferred sale on your home goes, you should DEFINITELY retain legal counsel asap whom does not have the conflict of interest you spoke of in your question. If you are looking for aggressive, effective representation to right the wrongs you feel you have endured to date, asap, then contact our Law Firm directly.

I would need to read a copy of the order before I could give an opinion. If you would fax me a copy of that order I will call you with my suggestions. I will be leaving out of town tomorror, but will be back on Monday. Good Luck, Pat McCrary
