Legal Question in Family Law in California

exemption request

My grandson was taken into protective custody because my daughter had a public outburst and she was with the school nurse @ the time CPS and the Police were called and they drug tested her and she was positive for methamphetamine and she was also charged with cruelty to a child. I am trying to get temporary custody of my grandson. The cps worker said I have to fill out an expemtion request for my past criminal charges that were dismissed. How long does this process take and it is necessary to fill out since all my charges were dismissed. I am having a hard time getting my phone calls returned from the cps worker.

Re: exemption request

You should consult with an attorney regarding your rights. These cases move quickly and you can be left out if you hestitate. These cases are driven by the facts and the attitude of the social worker. Therefore you need to be very nice to the social worker.

this is the sort of goose chase cps sends grandparents on to get around the policy of giving them preference over other fost/adopt parents. put everything in writing.
