Legal Question in Family Law in California

I am trying to file custody for my 14 year old daughter, and divorce her father at the same time. I have no income. I'm in Stockton CA and he is in Sacramento CA. Our daughter is currently with me. I filed for custody and a divorce back in 2004. He was served, but that was the extent of it. Can anyone help me?

Your best source of help in your situation is the Family Law Self Help office or Family Law Facilitator (different names in different counties) in the county in which you originally filed. That filing may well still be considered active, because unlike most civil actions divorces remain open a long time unless they are resolved by judgment or settlement or the parties dismiss them. So that is where to start. They an help you find out if your case is still open and if so, what to do next. If it is closed and your first case was in San Joaquin County, they can walk you through opening a new case. If it was in another county and closed, then you will open a new one in San Joaquin because that is where the child now resides.
