Garnish Wages for Late Child Support

My ex-husband is supposed to pay child support on the first of every month. His check are rarely post-marked before the fifth. Can I have his pay garnished to insure that I am paid on time?

Absent something contrary in your judgment, you are entitled to a wage assignment which requires your spouses employer to pay you direcrtly.

You may have his wages "assigned" at any time. In that case you will receive payment from each of his paychecks. You may have a delay of over five days each month and will receive the payments as he is paid, not monthly. The local facilitators office can assist you in preparing the wage assignment.
