Legal Question in Family Law in California

a guardianship hearing is scheduled for october , the mother of this child had kept child from having any contact with us since she was served with court papers, now i have in custody this child as per mother on a short visit only because i am in a different location where the father is not present. child is 2 1/2 yrs old insisting she stay with me. this child has not have any of her medical/dental needs met as her mother stated she would take care of it...........the child was exposed to a physcial altercation involving two individuals who were fighting in front of her..........i have the child now, this minute........do i give her back to her mother or do i keep her and let her mother know i plan to do this>>????? i am confused help me asap
