Legal Question in Family Law in California

Hello,

I am wondering two things. My attorney has just been asked if we will accept service on divorce papers, but I am now switching attorneys. Someone said this grants me an automatic 30 day extension to receive service by a state statue, but they said to check b/c this was a different area of law than their expertise. Secondly, is it possible for my soon to be ex-husband to order a motion for temporary support if I have not been served, or accepted service, on such papers? thanks!

The 30 days runs from when the papers are served, regardless of whether the attorney is served or you are served.

The court issues orders, including temporary support orders, but only only after a hearing on a motion or a similar procedure called a request for order.
