Legal Question in Family Law in California

I hold all the cards, do i still have to talk to him?

Father moved to NC. Mother in CA, was awarded Sole, Legal, and Physical custody with No visitations to him.During this time he harassed me leaving me voice mails and messages on my phone and emails, which are documented.

5 months later emails he would like to know his daughter. We went back and forth for months. He sends her gifts and welcomes the child support to be garnished from his wages. During that time he mentions he would like to plan to visit CA to see the baby for the first time on her 1st birthday. We planned for his visit for 3 mos. I scheduled time off from work. 5 days prior, he cancels. With me having all the rights to my daughter with no visitations to him, I still wanted him to be apart of her life. I told him I wouldnt sign anything, but that he had my word. We would continue to do Web-Cam. He was welcome to call her anytime, I would continue to send him pictures as she grows, and that he was free to visit her at anytime during the year, and that I would work around his schedule when he was here. What are his chances for custody and or visitations? What will he need to do? He lives in NC. If he contacts me,i would prefer not to talk to him, but for the best interest of the child-should I? Plz advise.

By talking with him you can reduce the possibility of the court becoming involved. Once the court is involved a judge could be making the decisions. As to the possibility of his having custody and visiation the answer would depend on the child's age, the county in which you live and his background, such as criminal convictions, drug use, etc.
