My husband is in the military we are going through a divorce and have a five year old girl together who mostly stays with me while visiting him over the summer he decides that he is not going to let her come home. is that legal and what can I do to get her back?

You need to contact a family law attorney immediately. The existing child custody and visitation schedule will determine whether he has committed a crime. If you do not have custody and visitation order take immediate action to obtain a custody and visitation order.
Prior to contacting an attorney you need to put together a history of where the child has lived, before and after separation. You action will need to be filed in the county where the dissolution (divorce) is filed. You should contact an attorney who handles custody matters in that county.
