Legal Question in Family Law in California

my kids dad lives in texas and i live in california. He hasn't seen them since they were 4 months old they are now 2 and 3. he is trying to get custody. I live with my girlfriend. What are the chances he will get them and will my relationship affect the outcome?

No one can predict what a Court will find is in the best interests of your children. However, if your ex hasn't seen the kids in over a year, the Court may use a step up visitation plan where they start out with short supervised visits and work him up to longer periods. Although he hasn't seen them in over a year, the Court is still likely to allow him visitation absent some danger he poses to the kids.

As for your relationship, as long as it isn't adversely affecting your kids, your husband can't use that against you.
