Legal Question in Family Law in California

Make payments outside support order

I owe child support for two children in another state. (they are in OK and the support order was issued in CA) I now live in WA and want to start making payments to the children's mother without involvement from the courts. What kind of documantation do I need, or can this even be done once a Child Support order has been written?

Dear Inquirer:

Nothing herein shall create an attorney-client relationship, unless a written retainer agreement is executed by the attorney and client. This communication contains general information only. Nothing herein shall constitute an attorney-client communication nor legal advice. There likely are deadlines and time-limits associated with your case; you should contact an attorney of your choice for legal advice specific to your personal situation, at once.

NOW, IN RESPONSE TO YOUR INQUIRY --

If neither parent nor the children live in CA, the state no longer has jurisdiction to modify the order. Most likely the modification must take place in the children's home state, the state where they have resided for the last six months. Trying to modify the order (by agreement) without court participation is risky for both the payor and the payee. I would not recommend it as it can come back to "bite" you years and years later.
