Legal Question in Family Law in California

Marriage after divorce filing.

If my fiance filed for divorce over a year and a half ago, however, it is not completely finalized because of a financial situation is he able to marry again? He is legally separated but the divorce is not 100% finalized.

Marital stauts may be terminated separate from the financial issues. It can be done by stipulation of the parties are via a motion, so it can be accomplished quickly.

Your fiancee is not able to marry until a "dissolution of his marital status" has been granted by the court. There is a way to accomplish this, although there are still property issues to be handled. That method is called a "Status-Only Dissolution." If you have further questions, please contact me for a free, one-half-hour consultation.
