If you are NOT married and have never been to court for a custody battle...can you move your child out of the state of California if the father is notified of where you are moving to?

Yes. However California will retain primary jurisdiction over the child for six months. If the father files for a custody determination in California you will have to return and defend here, an there is a fairly good possibility he will be granted an order for return of the child to California, which any other state's courts will enforce.
