Legal Question in Family Law in California

I've been married for 25 years and getting a divorce if I work can I still get spousal support I need to pay for my own health insurance when the divorce is final I have colon cancer stage 3 and cant afford the house and my health insurance how do they basic the amount if I get spousal support. Thanks

you will likely qualify for long term spousal support. The court will not do anything for your housing situation. You will likely get an order that your husband must keep you on his HMO insurance for a certain number of years, this amount may be deducted from your spousal support award.

I am so sorry for your illness. Unfortunately, most insurance companies will not cover you after the divorce is finalized, except through COBRA. You likely will qualify for lifetime support, unless you waive it (make sure you have an attorney read any agreements). Family Code Section 4326 covers the factors the Judge will consider in deciding whether to grant a request for spousal support and the amount.
